These Terms of Use (“Terms”) form a legally binding agreement between you and Klikta, Inc., a Delaware corporation (“Klikta,” “we,” “us,” or “our”).
By downloading, installing, accessing, or using the Klikta mobile application and related services (collectively, the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
iOS Notice
If you obtain Klikta through the Apple App Store, your use of the Service is also subject to the Apple Standard End User License Agreement. If there is a conflict between the Apple terms and these Terms, the Apple terms govern solely with respect to your relationship with Apple.
1. The Klikta Service
Klikta helps people discover photogenic locations, reproduce inspiring shots, and share visual experiences.
Features of the Service may include:
• Creation & Discovery – exploring curated feeds, reference images, and mapped locations.
• Contribution – uploading and sharing photographs.
• Personalization – recommendations based on your activity, preferences, and approximate device information.
• Safety & Integrity – human and automated moderation systems.
• Shared Infrastructure – certain technical, analytics, and security components may operate across Klikta products.
We may introduce beta or experimental features at any time. These may change or be discontinued without notice.
2. Privacy
Providing the Service requires us to process certain personal data, which may include email details, authentication identifiers, photographs, device information, and location metadata.
Our Privacy Policy explains how we collect, use, and protect this information and outlines your rights and choices. By using Klikta, you acknowledge such processing.
3. Your Commitments
3.1 Eligibility
By using the Service, you represent that:
• you meet the digital age of consent in your country; and
• your access has not been previously suspended or terminated for violating these Terms.
3.2 Acceptable Use
You agree not to:
• upload unlawful, infringing, sexually explicit, hateful, violent, or otherwise harmful material;
• post content involving minors where prohibited by law;
• submit content you do not own or lack authority to license;
• publish identifiable individuals without legally required consent;
• interfere with, disrupt, scrape, hack, reverse engineer, or bypass protections of the Service;
• use automated systems or unofficial methods to collect data;
• reuse or commercially exploit photographs, routes, or other information from Klikta without permission.
We may remove or restrict content or access where necessary to enforce these standards or comply with legal obligations.
3.3 Ownership of Your Content
You retain ownership of content you submit.
To allow us to operate, improve, and promote the Service, you grant Klikta a non-exclusive, worldwide, transferable, sublicensable, royalty-free, perpetual, and irrevocable license to host, store, reproduce, adapt, modify, distribute, publicly display, create derivative works from, and otherwise use that content in any media, including for marketing and promotional purposes.
Where allowed by law, you waive moral rights in relation to these uses.
Because this license is ongoing, removing content from the Service does not affect prior or continuing uses.
4. Accounts & Authentication
You may choose to sign in to Klikta using third-party identity providers such as Apple, Google, or Facebook.
Klikta does not create standalone usernames or passwords.
By signing in, you authorize us to receive certain profile information from the authentication provider, as described in our Privacy Policy.
If you choose to authenticate, you are responsible for maintaining the security of your chosen method and for activities associated with your access credentials.
Klikta is not responsible for the security practices, availability, or actions of third-party authentication providers.
5. Attribution & App Updates
You authorize Klikta to:
• display your username and/or connected social handle as credit;
• use associated profile images for attribution;
• install updates, bug fixes, or improvements automatically.
6. Moderation, Removal & Access Restrictions
Klikta uses moderation systems to review content.
We may accept, refuse, edit, or remove submissions at our discretion for policy, safety, store-compliance, or legal reasons.
For repeated or serious violations, we may suspend, restrict, or terminate access to the Service.
If you believe a moderation action was taken in error, contact hello@klikta.app within 14 days.
7. Account & Data Deletion
If you are signed in, you may request deletion of your account and associated personal data directly within the app or by following the process described in the Privacy Policy. You may also contact us at hello@klikta.app. Requests will be handled in accordance with applicable law.
8. Disclaimers & Limitation of Liability
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted, secure, or error-free operation.
To the fullest extent permitted by law, Klikta is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.
Nothing limits liability that cannot legally be excluded, including for death, personal injury, fraud, or mandatory consumer rights.
You agree to indemnify Klikta from claims arising from your breach of these Terms or misuse of the Service.
9. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law principles.
Where mandatory local consumer laws provide otherwise, those rights remain. In all other cases, disputes will be resolved exclusively in the state or federal courts located in New Castle County, Delaware.
10. Changes to These Terms
We may modify these Terms to reflect legal, technical, or business developments. If changes are material, we will provide notice before they take effect.
Continued use of the Service after the effective date constitutes acceptance.
